  Microsoft accuses EU of 'unprecedented regulatory intervention'

Microsoft Corp. accused the European Commission yesterday of creating new law and engaging in "unprecedented regulatory intervention" in its antitrust ruling against the Redmond company. The assertion, part of a seven-page rebuttal from the company, was made public as the European Commission released the full text of its decision in the case. The 300-page decision details the commission's reasons for imposing a record fine and ordering behavioral remedies beyond provisions of the company's U.S. antitrust settlement. Together, the documents give new insights into the positions both sides took as they engaged in ultimately unsuccessful settlement talks before the commission's ruling March 24. They also give a sense for the arguments to be made in Microsoft's expected appeal to the European Court of First Instance.
