The lawsuit, filed Monday in U.S. District Court for the District of Massachusetts by San Diego-based law firm Robbins Geller Rudman & Dowd, was on behalf of plaintiff Gail Fialkov and others who bought Microsoft stock between April 18 and July 18.

If you didn't know by April that MS was having issues with the RT then you don't have a right to call yourself an investor. Do some research and stop trying to have someone else pay for your mistakes.

It describes Surface RT as "an unmitigated disaster". Spot on. Windows 8 should be included in that description.

#2: Windows 8 can be modified to be a nice OS. Yes, it isn't "right" for non-tablet use out of the box, especially for older people that like the navigation methods they have been using for 18 years.
In the Start screen move the Desktop tile to the upper left corner. Now people only need to tap the Enter key to get to the Desktop. Open regedit. Change the Desktop Windows metrics for the border and border padding are 1/3 the too thick on most PC's default size. Finally, Classic Shell's beta 3.90 is awesome. When installing make sure only the Start menu and update boxes are checked so it looks and acts like Windows 7. I have a lot of happy customers with this setup.

#5: The problem isn't only with Microsoft. Many big corps today treat customers like ATM"S and don't care what the end result is. It does appear that MS went downhill under Ballmer's watch by not caring what customer's wanted in the products they buy and by not looking over their shoulders at OSX and Android, acting like mobile wasn't worth their time and effort to get "right"

These "investors" have to be the stupidest and the planet. Between 18 April and 18 July MSFT stock went from $28 to $36 or about a38% increase! So, a 1000 shares would have netted you $8k in just a couple of months. Considering that this stock has been in the toilet for over ten years, that is HUGE!
The lawyers Rude and Dufus have no case.
P.S. Microsoft's game business took years to take off. It is now a billion dollar plus business . True - when a corporation brings in tens of billions a year that isn't much. If it were a stand alone business it would be great.
P.S.S. Those commercials showing the glaring differences between the Apple iPad and SurfaceRT are good (http://windows.microsoft.com/en-us/windows-8/compare?ocid=FY14_SEM_BNG_CPC#T1=dell-xps-10), just a little late as is the product.
